Introduction and General Statement

This Payment and Privacy Policy ("Policy") constitutes a legal agreement between teenkidschat.com ("TKC", "Platform", "Website", "We") and the user ("User", "You"). By clicking the "Make Payment," "Purchase," or similar button, you are deemed to have fully and unconditionally accepted all terms of this Policy. This Policy applies to all paid digital services, subscriptions, virtual currency (Gold, Rubby) purchases, usage rights, and all payment processes conducted via the epoint.az gateway provided by TKC. Proceeding with payment without carefully reading this Policy signifies your acceptance of its terms.


1. Legal Definition, Scope, and Application of the Platform

This Policy is valid for every payment made on TKC's website, mobile applications, and all subdomains ("the Platform"). It regulates the collection, processing, storage, and protection of all data directly or indirectly related to the payment process. The terms of this Policy apply in conjunction with the TKC User Agreement and Platform Rules. In case of any contradiction between documents, this Payment and Privacy Policy shall prevail.

2. Target User Group: Youth, Minors, and Parental Responsibility

While the Platform is primarily intended for youth, individuals of any age group may become members. According to the Civil Code of the Republic of Azerbaijan (Articles 28-30) and international child rights norms, any person under the age of 18 is considered a "minor." Any payment transaction made on the Platform by a minor is presumed to have been made with the prior explicit consent and under the supervision of their legal parent or guardian. Parents bear full and direct responsibility for their child's use of their payment methods (bank card, mobile payment account, etc.), failure to protect passwords, and for every expenditure made by the child on the Platform. TKC assumes no obligation for refunds or compensation for payments made without parental knowledge.

3. Payment Authority, Authorization, and Identity Verification

Payment transactions may only be conducted by the following persons:

  • The legal and factual owner of the payment method (credit/debit card, e-wallet, etc.) who has the legal capacity to enter into a contract under the laws of the country from which they are paying.
  • Persons authorized to conduct transactions based on a written, notarized, or legally valid digital power of attorney granted by the legal owner of the payment method.
  • The legal parent or guardian of a minor user.

TKC reserves the right to request one or several of the following documents from the user in any suspicious or high-risk transaction (e.g., unusually large amount, unusual frequency):

  • Copy of identity card/passport.
  • Document matching the name on the front of the card.
  • Copy of the signature panel on the back of the card (with CVV code covered).
  • Document confirming parental or guardianship rights.

If submitted documents are insufficiently clear or raise doubts, TKC has the right to cancel the payment and temporarily or permanently block the account.

4. Payment Service Provider (epoint.az) and Division of Liability

TKC does not directly accept payments. All financial transactions are processed through the "epoint.az" payment gateway, registered and operating in the Republic of Azerbaijan. TKC only receives a technical notification from epoint.az regarding the payment result (successful/failed). No sensitive financial information of the user—such as bank card number, expiry date, CVV/CVC code, 3D Secure password, or full cardholder name—enters, is transmitted to, or stored on TKC's servers. This information is processed only within the secure systems of epoint.az and the relevant bank. By making a payment, the user also agrees to the epoint.az user agreement and privacy policy. TKC bears no direct or indirect liability for technical failures, security breaches, data loss, or cessation of activity of epoint.az, banks, or other third-party payment systems.

5. Details of Collected and Non-Collected Payment Information

Collected and Stored Information (by TKC):

  • Unique transaction ID number (Transaction ID).
  • Transaction date and exact time (GMT+4).
  • Amount paid and currency type (AZN, USD, EUR, etc.).
  • Name and quantity of the purchased service (e.g., 1000 Gold, 1-month VIP).
  • User's TKC username and unique ID.
  • IP address, device type, and browser information used at the time of payment.
  • Transaction status (Successful/Failed/Canceled/Pending).
  • Payment confirmation code provided by epoint.az (if any).

STRICTLY NOT COLLECTED AND NOT STORED INFORMATION (by TKC):

  • The full 16-digit bank card number or its parts.
  • Card expiry date (MM/YY).
  • CVV/CVC security code on the back or front of the card.
  • 3D Secure/SMS verification password.
  • Full name of the cardholder (processed only by epoint.az).
  • User's bank passwords or mobile app login credentials.

6. Payment Security, Encryption, and International Standards

The epoint.az payment tool holds a compliance certificate for the international PCI-DSS (Payment Card Industry Data Security Standard) 3.2.1 level. All data transmission is protected by bank-level 256-bit SSL/TLS encryption protocols. The TKC Platform itself is also secured with a security certificate (HTTPS). However, users are obliged to take the following measures:

  • Use reliable anti-virus software on the device used for payment.
  • Avoid using public Wi-Fi networks when making payments.
  • Not enter card details anywhere other than on TKC, epoint.az, or the bank's page.

TKC is not liable for data theft, card cloning, or other fraud due to the user's failure to take their own security measures.

7. Role of Cookies in the Payment Process

Several types of cookies operate silently during the payment process:

  • Essential Cookies: Necessary for the proper loading and functioning of the payment page.
  • Security Cookies: Used to verify your session ID and IP address, prevent automated bots or brute-force attacks.
  • Functional Cookies: To remember language and currency on the page.

Most of these cookies are set by epoint.az and governed by their policy. Blocking these cookies in your browser may cause the payment page to malfunction and the transaction to fail.

8. One-Time Payment Model and Absence of Automatic Renewal

TKC does NOT have an automatically renewing subscription (recurring) model. Each purchase (Gold, Rubby, VIP) is a one-time payment made based on the user's separate and instant decision. When the VIP status period expires, the system does not automatically renew and no amount is charged from your card. To obtain a new service, the user must restart the same process. This allows the user to maintain full financial control.

9. Pricing Policy, Inflation, and Right to Change Prices

TKC reserves the right to change the prices of all digital packages and services (Gold, Rubby, VIP) offered on the Platform at any time without prior notice. Price changes may be due to:

  • Inflation and economic indicators.
  • Increase in operational (server, technical support, personnel) costs.
  • Changes in market competition conditions.
  • Implementation of additional features.

Price changes apply only to future purchases. They do not affect services purchased and actively remaining in the user's account prior to the change.

10. Legal Consequences of System Errors and Incorrect Pricing

Rarely, due to a technical error, software bug, or human factor, a service may be displayed at a price significantly different from its real market price (e.g., 0.10 AZN for 1000 Gold instead of 100 AZN). In such a case, TKC reserves the following rights:

  1. Cancel the transaction and sale.
  2. Reverse the incorrectly priced service (Gold, Rubby, VIP) added to the user's account.
  3. Require the user to pay the difference between the correct price and the amount paid.
  4. Close the accounts of users who exploit such technical errors for mass advantageous purchases on grounds of fraud.

TKC prohibits attempts to create a "disruptive effect" on the platform's operation based on purchases made at incorrect prices.

11. Legal Status of Virtual Currencies (Gold and Rubby)

Gold and Rubby are digital utilities. They are:

  • Not real currency, cryptocurrency, or securities.
  • Have no real purchasing power. They can only be used to activate certain functions (sending gifts, accessing premium features, etc.) within the TKC platform.
  • Cannot be converted into cash, other virtual currencies, goods, or services.
  • Cannot be bought, sold, or exchanged between users for real money, cryptocurrency, or other items. Such attempts are strictly prohibited and result in immediate account blocking.
  • Their value exists only within the TKC ecosystem and may be completely lost if the platform ceases operation.

12. Regulation of Virtual Currency Value and Functionality

TKC has the right to make the following adjustments when deemed necessary for the development and sustainability of the Platform:

  • Increase or decrease the price of services purchasable with Gold or Rubby (e.g., call minute, special gift).
  • Change the type of virtual currency required for a specific service (e.g., Gold may be required for calls).
  • Introduce new types of virtual currency or discontinue existing ones.
  • Change the list and functions of services purchasable with virtual currency.

These changes may be announced in advance, but this is not mandatory. By purchasing virtual currency, the user is deemed to have accepted the possibility of such future adjustments.

13. Non-Refundable Nature of Digital Content (Exception to Right of Withdrawal)

In accordance with the Law of the Republic of Azerbaijan "On Protection of Consumer Rights" (Article 33) and EU directives on digital content, there is NO right of withdrawal or refund for digital content (virtual currency, VIP status) delivered instantly and without quality defects. The service (e.g., Gold balance) is automatically loaded into the user's account within seconds following payment. From this moment, the service is considered "delivered" and "provided." Under no circumstances (user's regret, accidental click, minority age, parental lack of knowledge) are refunds applied for digital services.

14. Service Level (SLA) and Limitation of Expectations

Obtaining VIP status or a high balance does not guarantee the user:

  • Acceptance, attention, or positive feedback from other users.
  • Special respect or immunity status on the Platform.
  • That the Platform will operate 24/7 without interruption or errors.

TKC is not liable for temporary Platform downtime due to force majeure (clause 23), planned maintenance, or third-party service interruptions.

15. User Misunderstanding and Information Responsibility

The description of what each payment package (Gold, Rubby, VIP) includes and excludes is clearly stated on the payment page in plain language and capital letters. The user is solely responsible for understanding, for example, that VIP status does not include Gold, that Rubby is only for calls, or that special gifts can be purchased with Gold. Claims such as "I thought everything would be free when I bought VIP," "I assumed I could buy other things with Gold" are unacceptable and do not constitute grounds for a refund.

16. Legal Invalidity of the "I Was Not Informed" Claim

The "Make Payment" button is activated only after all necessary information (package selection, price, link to this Policy) is presented. The user has the opportunity to read this Policy, the Rules, and the "Frequently Asked Questions" (FAQ) section. Statements such as "I didn't read," "I didn't understand," "I didn't know," "I was inattentive," "I couldn't translate" are not legal defenses and will not be accepted as grounds by any court or arbitration body.

17. Fraud, Suspicious Transactions, and Chargeback (Payment Reversal)

TKC strictly investigates transactions flagged as "suspicious" by the payment system, including:

  • Payments made with stolen or lost cards.
  • Multiple failed payment attempts followed immediately by a successful large payment.
  • Payments from multiple accounts with the same card.
  • Payments from a region different from the user's country using a VPN.

In such cases, TKC has the right to suspend the transaction, cancel service delivery, and freeze the account and balances. If a user unjustifiably files a chargeback (payment reversal) request with their bank, this is considered clear fraud. Consequences:

  1. The user's TKC profile is permanently closed.
  2. All virtual assets (Gold, Rubby, VIP) are voided.
  3. Chargeback information (username, IP, transaction ID) is added to a "blacklist," prohibiting future use of the Platform.
  4. Transaction details may be presented to the relevant bank and law enforcement as an attempt to disrupt business activities.

18. Account Closure Due to Rule Violation

If a user violates TKC's General Rules (insult, threat, sharing prohibited content, spam, attempted fraud, etc.), their account is blocked in accordance with the User Agreement. This blocking is carried out regardless of the user's VIP, SuperVIP status, or unused Gold and Rubby balance. No refund, compensation, or transfer to another account is applied for digital assets in an account closed due to a rule violation.

19. Taxes, Bank Commissions, and Currency Differences

All prices listed on the site include TKC's service fee. However, the following costs depend on the user's own bank or payment systems and are their responsibility:

  • Foreign Currency Commission: If the user's card is in a currency other than AZN (e.g., USD, EUR) and the payment is displayed in AZN, the bank may charge a currency conversion fee.
  • Foreign Payment Commission: Some banks may charge an additional fee for foreign (outside Azerbaijan) online payments.
  • epoint.az Service Fee: The payment provider may require an additional minimal fee for some specific card types (this is clearly displayed on the payment page).

TKC bears no responsibility for the amount or application of these fees as it does not control them.

20. International Financial Sanctions and AML/CTF Compliance

TKC strictly adheres to the legislation of the Republic of Azerbaijan on Prevention of Money Laundering and Financing of Terrorism (AML/CFT). Within this framework:

  • Suspicious, unusually high-value (above a defined limit), or transactions linked to multiple accounts are recorded.
  • If legislation requires, information about these transactions may be submitted to the Financial Monitoring Service and other competent authorities.
  • TKC reserves the right to refuse payments from sanctioned countries or persons.

21. Regional Law and User Responsibility

The user is obliged to comply with all national laws of the country where they reside or of which they are a citizen while using the Platform and making payments. Some countries may have restrictions on payments to social networks, chat platforms, or foreign sites. All legal consequences (fines, tax issues) of payments made by the user violating such restrictions belong to them. TKC bears no responsibility for the user's violation of their own laws.

22. Limitation of Technical Liability

TKC is not liable for problems caused by third-party services, such as:

  • Outages of the user's internet service provider (ISP).
  • Network issues of the user's mobile operator.
  • Software or security problems on the user's device (phone, computer).
  • Technical failures of epoint.az, banks, or cloud service providers.
  • Massive disruptions in general internet infrastructure (DDoS attacks, international cable faults).

23. Force Majeure

TKC is exempt from fulfilling or delaying its obligations during the following unavoidable and extraordinary circumstances:

  • Natural disasters (earthquake, flood, fire, lightning).
  • War, military operations, terrorist acts, insurrection.
  • State-level decisions (embargo, sanctions, complete internet blockade).
  • Worldwide pandemics or epidemics.
  • Massive and prolonged power outages.

TKC bears no material or moral liability for temporary service suspension, data loss, or delays during such events.

24. Data Retention Period and Archiving

Payment-related collected information (clause 5) is stored in a legal archive for at least 5 (five) years for the following reasons:

  • Tax and financial audits.
  • Resolution of legal disputes and claims.
  • Reporting as required by banks and legislative bodies.
  • Investigation of fraud and breach cases.

After the 5-year period, personal data (IP, username) may be anonymized or destroyed. Anonymous statistical data may be retained for internal analysis.

25. Express Consent Declaration

By clicking "Make Payment," "Purchase," or a similar button, you officially and legally declare the following:

  1. I have fully and carefully read this 40-clause Payment and Privacy Policy.
  2. I completely understand all its terms.
  3. I fully and unconditionally agree to these terms.
  4. I give this consent without any pressure, deception, or misdirection, with full awareness and voluntarily.
  5. This consent does not contradict the legislation of the Republic of Azerbaijan or the mandatory rules of the country where I live.

26. Language Preference and Translation Risk

This Policy may be translated into English, Russian, or other languages for user convenience. However, all translations are for informational purposes only. In case of any ambiguity, misunderstanding, or dispute, the legally binding and authoritative text is the original version in the Azerbaijani language (Azerbaijani Turkish). The version in Turkey Turkish is a secondary reference text.

27. Severability

If any provision, clause, or sentence of this Policy is deemed unlawful, invalid, or unenforceable by any competent court or administrative body, that decision applies only to that specific provision, clause, or sentence. The remainder of the Policy remains in full force and effect and shall be fully implemented.

28. Accuracy of Age Declaration

By entering their date of birth during registration, the user confirms that the information provided is completely accurate and true. Stating an older age while being under 18 is strictly prohibited. TKC bears no responsibility for payments made based on the user's false age declaration. Parents are obliged to monitor the accuracy of their child's age declaration.

29. Continuity of Parental Supervision

Parents bear the responsibility to supervise their children's online activities, including virtual expenditures on TKC. This includes:

  • Keeping payment methods (cards, mobile accounts) out of children's easy reach.
  • Activating SMS notifications for card accounts.
  • Periodically checking the child's account activity.

TKC does not accept claims such as "my child knew my card details," "my son/daughter could have taken my card" and rejects refund requests based on such grounds.

30. Condition for Virtual Currency to be Deemed "Used"

If even 1 (one) unit from a purchased Gold or Rubby package is used, the possibility of returning the entire package is completely lost. Examples of use:

  • Sending 1 Gold as a gift.
  • Spending 1 Rubby for voice/call service.
  • Deduction of any virtual currency from the account balance.

This signifies the service has been "used" and "consumed."

31. Finality of In-Platform Expenditures

Each unit of Gold or Rubby spent (expended) by the user within the Platform is considered a final and irrevocable transaction. Examples of expenditure: sending a gift, making a call, purchasing a special emoji. These spent units cannot be refunded or compensated for any reason (accidental click, external influence).

32. Disclaimer of Psychological and Emotional Expectations

TKC is an entertainment and social communication platform. Making a payment or obtaining VIP status does not guarantee you any emotional, social, or psychological outcome. This means TKC:

  • Does not guarantee that other users will befriend you, message you, or respond.
  • Does not ensure special attention or respect towards you.
  • Does not guarantee the Platform will be a source of happiness or satisfaction for you.

Payment only expands the technical capabilities of the platform, not the social outcomes.

33. Refund Denial Based on Third-Party Content

The behavior and activity of other users are not under TKC's direct control. Therefore, the following reasons cannot be grounds for payment refund:

  • Another user blocking you, deleting content, or not responding.
  • Conflict, dispute, or disagreement with another user.
  • Another user sharing offensive, dissatisfied, or illegal content.
  • Conversation or connection not going as expected.

In such cases, the only legal recourse is to report that user to the Platform.

34. Time Limitation for Complaints and Claims

Any technical problem related to payment (e.g., money deducted but Gold not loaded), ambiguity, or complaint must be reported in writing to TKC's official Support Team ([email protected]) within a maximum of 30 (thirty) calendar days from the transaction date. The transaction ID number, date, amount, and username must be included in the communication. No application made after 30 days will be considered, investigated, or answered. This is a crucial measure for timely verification of user data.

35. Non-Transferability of Account and Assets

A TKC account and all associated assets (VIP status, Gold, Rubby, special emojis, "likes") are personal and non-transferable. This means they:

  • Cannot be sold, gifted, or transferred to another TKC user.
  • Cannot be inherited upon the user's death.
  • Cannot be converted into cash if the user wishes to delete their account.

The account itself (username, password) must also not be shared with third parties. Any such attempt results in immediate account blocking.

36. Silent Waiver of Rights

TKC's non-use or delay in using any right or provision in this Policy does not constitute a waiver of that right or an amendment. TKC may enforce its rights at any time.

37. Lack of Legal Force of Unauthorized Translations and Comments

Comments, advice, or translations regarding payments provided by persons who are not admins, moderators, or official support staff (ordinary users) on the Platform are not binding on TKC in any way. Only what is written in this document and written communications sent from TKC's official @teenkidschat.com email address are valid.

38. Dispute Resolution and Provision of Evidence

When a user raises any dispute (court, arbitration) against TKC or files an unjustified chargeback request with a bank, TKC has the right to present all evidence related to the user's activity. This includes:

  • Complete chat and activity logs.
  • Payment history and IP records.
  • Screenshots and evidence of rule violations (insult, spam).
  • All versions of agreements accepted by the user.

39. Bad Faith Complaints and Defamation

Attempting to obtain a refund after receiving service from TKC through false complaints and lies (e.g., "service not delivered," "my card was stolen") constitutes serious fraud and defamation. In such cases, TKC will:

  • Submit all communication and evidence to the bank and police.
  • Apply for the initiation of a criminal case against the user under relevant articles of the Criminal Code of the Republic of Azerbaijan (e.g., 178.3 - fraud, 147 - defamation).
  • File a lawsuit for compensation of damages (amount paid + compensation + legal costs).

40. Conclusion and Final Confirmation

These 40 (forty) clauses constitute the complete and sole agreement between TKC and You regarding payments and data protection. All previous negotiations and agreements (if any) are deemed void. This Policy can only be amended by a new version published by TKC. The current version of this Policy at the time of your payment applies to you. If you do not accept this agreement, you must not make a payment. By making a payment, you irrevocably and unconditionally accept all these terms.
